Refusing to take a breath test has earned a motorcyclist a one-year road ban and an $800 fine.

Cindy Clarke, the prosecutor, told magistrate Khamisi Tokunbo that police officers were on speed-check duty in Warwick when Yusuf Johnston stopped his motorbike and spoke to them.

She told the court Johnston, 42, from Paget, tried to continue on his journey, but a police officer suspected he had been drinking and detained him.

Ms Clarke said Johnston was asked if he had been drinking, but did not reply.

He was arrested and taken to Hamilton Police Station, but refused to give a breath sample.

The offence happened on September 8.
