A 31-year-old man admitted yesterday he refused to take a breath test after he was found lying in the road near a crashed bike.

Magistrates’ Court heard that Darrin Deshield, of Warwick, was found by a passer-by on January 4 on South Road in Devonshire in the middle of the road.

When police arrived, the passer-by was seen to be supporting Deshield against a wall and the bike was parked on the sidewalk.

Deshield admitted to officers he had been drinking but insisted he had been a passenger on the bike.

He declined to tell police who had been in control of the machine.

Deshield was arrested on suspicion of drink-driving, but refused to take a breath test at Hamilton Police Station.

A plea of not guilty to a charge of impaired driving was accepted by the prosecution.

Mr Wolffe highlighted that Deshield had previous convictions for similar offences.

Deshield told magistrate Juan Wolffe: “I’m willing to accept help where it’s needed.”

Mr Wolffe adjourned the case until Tuesday and released Deshield on $1,000 bail.
