A man who admitted he had been drinking whisky all day insisted to police he was not drunk, a court heard yesterday.

Kevin Morgan, 37, pleaded guilty to refusing to take a breath test after he was pulled over by police.

Officers had spotted Morgan’s bike swerving by police on Middle Road in Southampton, Magistrates’ Court heard.

He told officers he had been drinking Chivas Regal all day but was not drunk.

The incident happened at 11pm on November 5 last year.

Senior magistrate Juan Wolffe fined Morgan, from Southampton, $1,000 for failure to provide a sample of breath for testing and banned him from driving for 12 months.

Morgan was also fined $1,400 for failure to have third-party insurance, having an unlicensed motorcycle, and having no driver’s licence. He was also ordered to pay $800 on the spot for unrelated traffic offences dating back to 2013.
